Owner Of Dog Shot By Police Says Complaint Should Have Been Handled Differently
WORTHINGTON — A woman whose Rottweiler was shot and wounded by a Worthington police officer while responding to a complaint April 22 is criticizing how the department handled the call and released information about it.
An updated Facebook post on the Worthington Police Department page May 1 explained details regarding a report about dogs running at large and why the officer shot one of them outside the Worthington home of Luis Ponce and Erika Maldonado.
Police said one of the dogs aggressively barked and lunged at the officer before being shot twice in self-defense in the front right leg. The department also has posted body-cam footage of the shooting on Facebook.
Erika Maldonado said Rocky, the dog shot by the officer, survived the injuries and received treatment in Sioux Falls, South Dakota. She disputes information published by the police department.
In its Facebook post, the department said Maldonaldo and Ponce have received 10 complaints since 2016 about dogs at large for two Rottweliers and another dog. The post said the Rottweilers were observed running unrestrained last October and acted aggressively toward an animal control officer, and one of the dogs bit a child April 13 at the Ponce's home.
The officer responding to the April 22 complaint "was unaware at the time of this reported dog bit or any previous reports of the Rottweilers and their aggressive behavior."
Maldonado said that while she and Ponce have received multiple reports on their dogs over the years, not all of them were regarding her Rottweilers as the police department's statement seemed to illustrate to some.

"I didn't even have those Rottweilers in 2016," Maldonado said. "In 2016, I moved to our current house and I had two pitbulls back then. I would have them tied up or we had a sort of cage so they could just sit there but for some reason, they would find ways to get out. I think my two pitbulls would get out about two or three times. Even though they would get out, the police would always call me saying, 'Hey, do you own these pitbulls?'"
She also said an unlocked gate might have played a role in the April 22 complaint.
"The day before (the shooting), we were out cleaning outside during the night and totally must've forgotten to lock the gate," Maldonado continued. "I think the reason why the policeman said they had an issue with my Rottweilers is because they'd been out before two or three times. He's bringing up 2016 when I had the pitbulls. I don't know why they're bringing that up. If they said, 'Oh, we've been called 10 times,' then why were we allowed to keep having our dogs?"
I think so differently now. Now I'm too scared to even leave my dogs outside because they might escape.

Maldonado said police also didn't reveal the identity of the April 13 bite victim, who is her nephew. She said the police statement makes the incident, and her nephew's injuries, appear much more serious than they were.
"They're aggressive because he bit a 5-year-old and a lot of people think this happened in the street," Maldonado said. "No, this happened in my house (with) my nephew. I had Rocky in the kitchen and I had the baby gate up because he was eating. He went into Rocky's space and kinda irritated him and (Rocky) just bit him.
"My boyfriend's brother took him to the emergency room just in case something was wrong because there was just a little tiny bite mark (on his elbow). I guess the emergency people said that it was just like a scratch. The officer went there and asked if he was OK and just said, 'Just keep an eye on him just to make sure that he's not acting funny.' That's all that he said to us, they never told us to quarantine."
She said is not the only one in shock since the incident. At the time of the shooting, Maldonado's two children were also at home.
"My daughter saw it," she said. "My son witnessed how my dog was bleeding. My daughter, when she heard the first shot, I was in the living room and her room is upstairs. She right away looked, she heard the gunshot and then she heard the dog yelling. She heard another gunshot and that's when she ran downstairs saying, 'Oh my God, the cop just shot Rocky.' The day that he got out, I was so confused, I was like, 'How did they get out if they've never gotten out (since the October report)?' I think so differently now. Now I'm too scared to even leave my dogs outside because they might escape."
Maldonado said she considers the police releasing the information on Facebook as been a breach of her privacy.
"I think it's wrong that all of that (information) on their page," she said. "Putting my name and (Luis's) full name and everything, bringing up our whole police records. A lot of people pass by more (often) to see everything. People know where we live and everything because they put our information out there publicly without our permission. It just escalated to this point that we didn't even do anything."
Maldonado said communication, like there had been in prior complaints, may have prevented Rocky's shooting.
"I think he (the officer) should've stayed in his car, called me like they always have or called Animal Control," Maldonado said. "There's a lot of things that he should've done; pepper spray him, taser him or whatever. If he — like he said when he pulled in — thought my Rottweilers were so aggressive, why did he even get out of his vehicle? Why did he say, 'Do you want a car ride? Come on, buddy?' I think he should've approached it differently instead of how he did."
The police department declined further comment on the incident.

The clip was shared by Jennifer Greenberg (@the_green_bird_brigade), 42, who is based in Austin, Texas. The video, which was captured in Greenberg's home, has had views over 674,000 views since it was first posted on March 29. "I rescue and rehabilitate parrots, as well as use my social media platforms to educate others on better care for their birds," she told Newsweek.
The latest bird she's been caring for is Poncho, a 39-year-old yellow-naped Amazon parrot. Born in New York in 1985 and purchased from a bird store by his original owner, Poncho spent "the majority of the first 32 years of his life in a tiny cage," according to a caption shared with the video, which shows Poncho trying various things for the first time, from new foods to stepped onto Greenberg's arm.
His first owner had a large dog that "went after Poncho," so the parrot was "left in a room alone where the dog couldn't get him for years," the caption noted.
Poncho has been with Greenberg for two weeks and "the biggest change I have seen in him is his willingness to trust me. He has never really trusted people before due to his background and being alone so long."

Amazon parrots are known for their "excellent ability to mimic" and the yellow-naped ones are among those that appear to have the best potential for talking, laughing, coughing or even imitating a baby's cry, according to the nonprofit.
As entertaining and engaging as they may seem, Amazon parrots don't always enjoy being touched or "cuddled," the nonprofit warns.
"Some may be considered hyperactive or short-tempered" and they're generally "not good pets around children," the nonprofit added.
'He Is Quickly Learning'Poncho was given to a friend of his first owner seven years ago, when the former owner "could no longer care for him due to old age," according to a caption shared with the post.
"Unfortunately, Poncho's new family didn't know much about parrots, especially parrots like Poncho, who have trauma from their previous life. I hope to completely rehabilitate Poncho and help him find a life with someone who will give him everything he needs and deserves," the caption adds.
A message overlaid on the viral clip says: "Things my 39 year old Amazon parrot did for the first time this week."
The video goes on to show Poncho experiencing new food, such as vegetables out of a bowl. A note across the clip says "Poncho has been on a junk food diet his whole life...So I started teaching to eat healthy foods from day 1."
Poncho also learned to step onto Greenberg's arm as she lowers it to him, as seen in the video. "Poncho has spent most of his life alone, so he isn't very trusting of people," however, "he is quickly learning that I can help him get to where he wants to go," a message across the video reads.
The parrot is also shown sitting in a bigger enclosure. "This is a hard reset for him. He is not sure about the toys, the perches, any of it," a voice in the clip says.
As the footage shows a white cage, a note across the screen says: "Poncho has only known this small cage and the space around it for years."
The bird is later shown taking a "bath" by getting himself wet in a bowl in an enclosure. "He really didn't bathe in his last home and his feathers were very oily," a note across the screen reads.
The parrot later receives "scritches" from a hand that's shown massaging the top of the bird's head. He "even asked for more," a message on the clip notes, as the bird is shown moving closer to the hand.
Poncho also managed to leave the safety of his cage, making his first step out of the cage and heading downstairs for the first time. The footage shows Poncho on a perch in a living room setting.
